Terms of Services
Before sending an order for art commission, please take the time to read this form which contains the terms of services as well as conditions. This serves as a contract between the artist and the client to ensure that good quality service and product are delivered as much as possible. Moreover, it contains the type of service being delivered to the client to ensure that the latter gets what they pay for. Please read carefully and be guided accordingly.
Rules & Policies
-
Samples and their respective prices are provided. You can view the page beside this ToS page.
-
Prices are set based from their quality; the amount of time spent to make the piece and labor exerted. They may change over time depending on economic factors (i.e. inflation rate).
-
Additional charges may apply to complex character designs.
-
Payments upfront should be of priority before the artist starts doing the commission. The payments can be made partial or full. However, if the client gives a partial deposit at the start of the order, the artist shall not deliver the finished product unless the other half of the payment has been made.
-
The client must send a complete character reference; preferrably digital with the color swatches. Once the artist approves the order, the artist will send an invoice through email and payment should be sent thru Paypal only.
-
The artist shall send progress of the commissioned work thrice (sketch, lineart and base color). This gives the client multiple opportunities to make changes during the process.
-
Once the sketch has been approved, no refunds will be entertained. It is important to look over the samples and pricing thoroughly before making an order.
-
Once the BASE COLOR stage has been approved, it goes straight to shading, lighting and finishing touches. All changes should be made final at this stage. When it is done, the artist shall deliver the finished product through email or any social media platform that the client has. However, email is much preferred to preserve the quality of the images.
-
The artist shall post these finished works with their watermarks over the image as part of their portfolio and in their active social media platforms for self-promotion.
-
The client shall choose whether they would prefer to receive their finished works with the artist's signature/watermark (placed at the lower corner) or none presuming that it will be used for personal use only.
-
Personal commission pertains to the kind of commissioned artwork in which ONLY the client can use it for personal purposes. Selling/reproducing commercially is NOT ALLOWED.
-
Commercial commission, on the other hand, is a kind of commissioned artwork in which they will be sold in retail (online or physical) as merchandise. Aside from the commission fee, a royalty fee shall be added. Usually when the artworks will be sold as merchandises, the artist shall receive a certain portion (percentage) of the retail seller's total revenues which will cover the royalty fee. On the other hand, if the artworks will be used as downloadables, a one-time royalty payment will be added. It is best to contact the artist to discuss about the royalty fees for a fair and smooth transaction.
-
The duration of the commission will take up to 4 weeks after the payment has been made. This depends entirely on the volume of clients and the type of commission requested.
-
No shipping fee will be issued as the digital goods will be sent online.
The artist has the right to refuse an order if any of the following scenarios have occurred
-
The client requests for genres/themes which the artist does not draw or does not feel comfortable in drawing (i.e. mecha, bara, furry, yaoi/yuri, gore, monsters, porn, extremely sensitive material or not safe for work).
-
The client requests for a specific art style which completely deviates from the artist's art style. The artist will draw on an art style that they are most comfortable with and is not obligated to imitate or mimic someone else's art style just because the client has any form of attachment to it.
-
The client refuses to pay and insists on the artwork to be offered for free.
-
The client refuses to pay and insists on doing shoutouts or reviews as compensation.
-
The client attempts to haggle the artist to lower their prices for any reason or offer discounts even to the artist's package offers which already have discounted prices.
-
The client resorts to inappropriate behavior and language towards the artist (i.e. asking very personal questions, calling pet names, aggression, forcing friendships, throwing tantrums etc.)
-
The client does not comply with the Terms of Services stated.
The client is entitled for a refund when any of the following scenarios occurred:
-
The commissioned work took longer than 4 weeks after the payment has been made. A full refund will be issued if no progress has been made.
-
For partial progress, a partial refund will be issued only when it took longer than 4 weeks.
-
A refund will NOT be issued when the client changes their mind during the commission process, especially NOT when the finished product has been delivered and the client decides that they don't want it anymore (refer to Rules & Policies #7)
By ordering, the client hereby abides to the terms of services and conditions stated above otherwise the artist shall not entertain them further.
